Debt Can Be Good With A 1031 Exchange

We all know that the 1031 Exchange is used for transferring equity from an old property to a replacement property. What is not customarily known is that you can use some of the equity from your property through proper refinancing. You can use pre-exchange refinancing or post-exchange refinancing.

In a 1031 exchange, all the proceeds from the sale are supposed to be passed on to the Qualified Intermediary - this prevents you from receiving any cash benefit from the sale. There may be times, however, when you would like to use some of that money for other purposes. If you decide to refinance your property shortly before the 1031 exchange and use that equity for your desired luxury item, you may find yourself violating IRS rules. (IRS vs. Garcia)

Garcia was a taxpayer who decided to refinance his property in anticipation of the 1031 exchange. The IRS successfully argued that when Garcia took out money before the 1031, it was akin to telling the settlement agent to pay him some of the sale proceeds at closing. In short, you cannot take out your equity just before the 1031 exchange. Cashing out equity, called "boot," is acceptable if you pay taxes on it. Garcia tried to avoid the tax and ran afoul of the 1031 rationale, and the IRS.

The other way of recovering funds via refinancing is the Post 1031 Exchange Finance on the replacement property. This is a good way for you to take some of that equity out of the replacement property and buy more real estate. There is a question, however, on how long you have to wait before the refinancing after the 1031 Exchange is completed.

There is debate on how long one must wait after the 1031 exchange to show the IRS, through the closing statement, that you have invested all of your equity into the replacement property. Some say wait a nanosecond to establish a separate transaction and a new settlement statement to show that the replacement property was encumbered with new debt via a loan or a mortgage. Once this is established, there is a cash payment from the lender to you. Essentially, you have tapped into a pool of money made available through the 1031 exchange.

There are risks in the nanosecond interpretation since there is no definitive IRS rule regarding how long you have to keep the equity in the replacement property. In order to avoid the Garcia trap, or a negative ruling from the IRS, it is deemed prudent to keep the equity in the replacement property until the following tax year, or until two years have passed from the 1031 exchange to the ultimate refinance. - 23208

Constantly exposing the majority of your chips to high risk will only lead to a sudden burnout; you'll be off the game before anyone else, losing all your chips in a few fell swoops.

What then, is the right way to play poker? Anyone who plays often enough will quickly surmise that getting ahead in poker requires more than considering just your own hand and chips. You need to get a feel for the hands and chips of the other players around the table, too. Once you get a good feel for the game, you'll know that putting in all your chips in one hand is a bad idea. The way to go is to invest little by little, spreading out your game to good, but not necessarily great, plays.

The same principle applies to trading. The game table is essentially the market, and how it affects your investments. You'll need to avoid having all your capital placed onto one investment. Spread it out into a number of decent deals, and then if one fails, you won't be as devastated. - 23208

There are many excellent books that teach these patterns in detail, after using the patterns for a while it becomes second nature.

What is a reverse mortgage?? Do I want it?

If you have already heard the term reverse mortgage, it still sounds like a strange thing. If this is the first time you are hearing the term, it will probably sound like some kind of shady deal. Reverse mortgages are becoming more and more popular these days, but are they scams or are they legitimate?Is it really possible to sell your house back to the bank and still retain the deed to it? Will the bank really pay YOU the mortgage payments? Let's review what a reverse mortgage is so these questions can be answered.

The name is somewhat misleading. A reverse mortgage is a loan that is structured like a mortgage, with YOU as the lender and the BANK as the buyer. In the U.S., homeowners wanting to initiate a reverse mortgage must be at least 62 years old, and own all or most of their home. The qualifications may differ in other countries. These backwards mortgages are usually performed through a bank or broker. The senior citizen homeowner essentially sells his or her house to the bank, in return for receiving periodic mortgage payments. So what are the benefits to a reverse mortgage? It provides a constant and dependable stream of retirement income. The amount of money they provide during retirement can vary. A reverse mortgage can supplement a senior citizen's income. The amount depends on the homeowner's age, equity of the house, interest rate on the loan, closing fees, and a few other factors.

A common misconception about the reverse mortgage is that the bank eventually owns your house. This is not true! The deed remains in your name throughout the entire term of the process. Note that there is interest on the loan payments, but it is deferred until the loan is repaid.

The homeowner can remain living in the house during the entire term of the reverse mortgage. The loan becomes due only when the homeowner moves out, such as moving into a nursing home, or becomes deceased. At those times, the survivors can repay the loan themselves if they want to keep the house. They can also sell the home and repay the loan plus the interest in full. The money paid to the homeowner as mortgage payments must be repaid to the lender when the loan becomes due.

It takes an extremely disciplined forex trader to be able to stick to their forex strategies and trade without emotions such as fear and greed entering their forex trading decisions. When you bring human emotion to the table it changes the patterns of your forex trading system and can change the results. If your emotions aren't right for trading it usually alters your trading in a negative way and often turns a profitable trading strategy into loser.

Another problem with foreign exchange dealing is the market operates 24 hours a day, and never stops to sleep. While this is an advantage in some ways it can also be a big disadvantage. The disadvantage for a foreign currency dealer is you cannot watch the market all the time. You can't be there to take all your deal signals. This alone can mean that a number of forex strategies are impossible to follow, if you are sleeping when the strategy gives you a trade, unless you are working with a team of people who can monitor the markets day and night.

Finally, it should be noted that currency trading is not for everyone, as a lot of forex strategies can be hard to follow. I don't know about you but I don't want to spend my life watching charts and I decided a while back that being a foreign exchange professional is really not for most people. One solution is to identify forex strategies which use automated software programs which will monitor the action for you 24 hours a day and do the currency trading for you automatically. Using such a system they will enter and exit your trades when the market gives them the signals.
